Jane Lambert   Patents Court (Mr Justice Mellor)  Godo Kaisha IP Bridge 1 v Huawei Technologies Co., Ltd and others [2021] EWHC 2826 (Pat) (22 Oct 2021) In Disclosure - Anan Kasei Co. Ltd v Neo Chemicals & Oxides (Europe) Ltd   I discussed a case in which Mr Justice Mellor refused to relax restrictions on highly confidential material that had been disclosed for external eyes only ("EEO").  EEO essentially means a party's solicitors and counsel but not the party itself.  In  Godo Kaisha IP Bridge 1 v Huawei Technologies Co., Ltd and others [2021] EWHC 2826 (Pat) (22 Oct 2021), the same judge reached an opposite decision even though he applied the same guidelines. The application for the relaxation of EEO restrictions was one of two applications by Huawei Technologies (UK) Ltd. ("HTUK"), a wholly-owned subsidiary of the Chinese telecommunications equipment giant, Huawei Technologies Co. Ltd. The other application was for an order for the claimant, Godo ...

Jane Lambert Patents Court (Mr Justice Birss)  Conversant Wireless Licensing SARL v Huawei Technologies Co. Ltd and others [2020] EWHC 256 (Pat) (10 Feb 2020 This was an application by the claimant, Conversant Wireless Licensing SARL  for disclosure of the licence agreements and assignments relating to 3G and 4G patents that had been entered by the defendants, Huawei Technologies Co Ltd., ZTE (UK) Limited and their British subsidiaries. Substantially the same application had been made to His Honour Judge Hacon at the case management conference in the action which took place in July 2019. The later application was heard by Mr Justice Birss who delivered judgment in  Conversant Wireless Licensing SARL v Huawei Technologies Co. Ltd and others [2020] EWHC 256 (Pat) on 10 Feb 2020. The reference to the CMC in the transcript of Mr Justice Birss's judgment is [2009] EWHC 1982 (Pat) but I think that must be a misprint for [2019]. Judge Hacon refused Conv...

Ltd and other s [2020] EWHC 14 (Pat) (8 Jan 2020) This was a patent infringement claim by  Conversant Wireless Licensing SARL  against Huawei Technologies Co Ltd .,  ZTE Corporation  and their respective British subsidiaries.  The patents alleged to have been infringed are European patents (UK) 1 878 177  ("177"), 3 267 722  ("722") and 3 197 206  ("206"). Conversant had declared those patents to be essential to certain 3G and 4G standards. It argued that manufacturing, distributing or marketing items that met those standards without its licence would necessarily infringe the patents. The defendants contended that the patents were invalid on various grounds and denied that the patents were essential to t...

Ltd. and Others     [2019] EWHC 1687 (Pat) This was a claim by Conversant Wireless Licensing SARL   against Huawei Technologies Co. The patent in suit was European patent (UK) 1797659 entitled  Slow MAC-e for autonomous transmission in high speed uplink packet access (HSUPA) along with service specific transmission time control . The claimant contended that the patent was essential to an aspect of the 3rd generation mobile phone Universal Mobile Telecommunications Standard ("UMTS") referred to as Uplink DRX,  As the defendants distributed mobile phones that complied with that standard the claimant complained that the defendants would have infringed its patent.  The defendants denied essentiality and hence i...

Ltd and others   [2018] EWHC 808 (Pat) Although the precise relief sought in these proceedings is not mentioned in this judgment, it must have been a strike out or stay of a claim for patent infringement.  The applicants were the Chinese companies,  Huawei Technologies Co.
