Brexit - Why do I follow the Art 50 (2) Negotiations when I am an IP Lawyer?

Jane Lambert The answer is very simple.  The laws upon which my clients will rely to protect their intellectual assets  in the future will depend to a large extent on the outcome of those negotiations.  If agreement can be reached on the terms upon which the UK leaves the EU there will be a transition period between 29 March 2019 and 31 Dec 2020 during which long term  arrangements for the future relationship between the UK and EU including the enforcement of intellectual property rights can be negotiated. If agreement cannot be reached there is a danger that important legislation such as   Regulation (EU) No 1215/2012 on jurisdiction and judgments in civil and commercial matters  will cease to apply to the UK after 29 March 2019. Standard YouTube Licence Jane Lambert March's Brexit Briefing  which I published today in NIPC Brexit discussed the draft withdrawal agreement  contemplated by art 50 (2) and the guidelines for negptiations on the future relationship between the UK and EU provided by the European Council  and the European Parliament . While welcoming the progress that has been made to date I warn that nothing is agreed until everything is agreed and that there are plenty of things that can go wrong between now and Brexit day/  It is quite possible that the EU treaties will fall away on 29 March 2019 without anything taking their place.  Even though the government has assured them of a period of stability between that day and 31 Dec 2020, my advice to businesses on both sides of the English Channel and Irish border is to continue to plan for the worst (that is to say, no agreement at all) as well as hoping for the best. Although it has not yet been presented to the British government and there has already been some grumbling from the PM and others it is unlikely to be rejected out of hand. There were some welcome signs of pragmatism in the PM's speech at the Mansion House on 2 March 2018. There were also some crumbs of comfort for the ratification of the UPC Agreement and perhaps even continued British participation in the Court after Brexit. Read more
