Patents - Celltrion v Genentech

Casale Licence CC BY 2,5 Source Wikimedia Commons Jane Lambert Patents Court (HH Judge Hacon)  Celltrion Inc v Genentech, Inc and another [2025] EWHC 174 (Pat) (30 Jan 2025)   This was an action by Celltrion Inc ("Celltrion") for the revocation of European patent (UK)  3 805 248 B1  for a "Process for concentration of antibodies and therapeutic products thereof" ("the patent") held by Genentech Inc ("Genentech") and Novartis AG ("Novartis") and a counterclaim by Genentech and Novartis against Celltrion and its UK subsidiary for infringement.  The action and counterclaim were tried by His Honour Judge Hacon between 24 Oct 2024 and 1 Nov 2024.  The learned judge delivered judgment on 30 Jan 2025 (see  Celltrion Inc v Genentech, Inc and another  [2025] EWHC 174 (Pat) (30 Jan 2025)).  By para [193] of his judgment, he found that the patent was valid and infringed. Conrad Lant Author Jonas Rogowski Licence CC BY-SA 3. 0 Source Wikimedia   Jane Lambert Intellectual Property Enterprise Court (Recorder Amanda Michaels)  Lant v Plastic Head Music Distribution Ltd and another [2025] EWHC 1954 (IPEC) (31 July 2025) Between 1979 and 1986, Conrad Lant  and Anthony Bray were members of a band called " Venom ".  Each of them had licensed the sale of merchandise reproducing logos and other artwork from that time without the other's consent.  Mr Lant brought proceedings against Mr Bray and his licensee, Plastic Head Music Distribution Limited, for infringement of any copyright that might have subsisted in those works.  Mr Bray and Plastic Head said that Mr Bray was entitled to copyright in some of those works and denied that copyright subsisted in others.  Mr Bray brought infringement proceedings against Mr Lant and his licensee, Razamataz.com Ltd., by way of counterclaim.  The action and counterclaim were tried by Rec...

  Jane Lambert Intellectual Property Enterprise Court (HH Judge Hacon)  Battlekart Europe SA v Chaos Karts 1 Ltd and others [2025] EWHC 1936 (IPEC) (25 July 2025) This was an action by Battlekart Europe SA ("Battlekart") against Little Lion Entertainment Ltd ("Little Lion"), its subsidiaries, Chaos Karts Limited and The Ents Inc Limited and their director, Thomas Maguire for the infringement of European patent (UK) 3 304 522 B8  and a counterclaim by the defendants for revocation of the patent on grounds of obviousness , implausibility and added matter.   The action and counterclaim were tried by HH Judge Hacon between 17 and 19 June 2025.  By para [136] o f his judgment in Battlekart Europe SA v Chaos Karts 1 Ltd and others [2025] EWHC 1936 (IPEC), which he handed down on 25 July 2025, the learned judge held that the patent was invalid for lack of an inventive step and added matter. The work in which copyright was claimed was a black and white line wall drawing by the first claimant, Shantell Martin MBE which filled one end of the sculpture court of the Buffalo AKG Art Museum .  The transcript of Mr David Stone's judgment in this case refers to the "SKG Museum" in two places in the second paragraph.  That appears to be an error because there is an AKG Museum in Buffalo, New York named after its benefactors John J. Albright ,  Seymour H. Knox II , and Jeffrey Gundlach , but the only museums that showed up on a Google search of "SKG Museum" were in Thessaloniki...
